- Three Year Rule: The three year rule prohibits the discharge of taxes incurred and filed three years before bankruptcy.
- Two Year Rule if not filed or filed late: A taxpayer remains liable when he files his tax returns late but not more than two years prior to bankruptcy. The tax debt is dischargeable if the tax return was filed more than two years before bankruptcy.

- Returns prepared by the IRS: IRC Section 6020(b) filings ,where the IRS assesses the tax for the taxpayer, cannot be discharged.
- Eight month rule and OIC: Income taxes assessed within 240 days before bankruptcy can not be discharged. For pending OIC, the 240 day period is extended to 270 days.
