Joint child custody is also called joint custody. Joint custody occurs when both parents have joint legal and physical custody. Usually both parents have joint legal custody. Joint legal custody means that both parents are in charge of the child’s health, education and welfare. The law encourages joint legal custody, requiring parents to work together on major decisions that will affect their child. These areas include education, health and religion. Sole legal custody occurs when only one parent is legally in charge of the child’s health, education and welfare. Guardianship is a custody order giving legal custody of a child to a person who is not the child’s parent. For example it can be a grandparent , an uncle or an aunt.
