Modesto Divorce Attorney Assisting Clients with Post-Divorce Issues and Modifications

No matter how thoroughly a person plans for the needs of the future at the time of divorce, things have a way of changing. The economic downturn of the past few years has resulted in a larger number of people than usual finding it difficult to fulfill the terms of court-ordered support.

If you need help changing a court order after a divorce, or you need assistance enforcing a court order, contact the Law Office of Christie Lee for a free half-hour initial consultation or call 209-910-5291.

Divorce Agreement Modifications and Enforcing Orders

Modesto divorce lawyer Christie Lee helps clients with both the enforcement and execution of divorce orders for support and property division and with modification of orders when circumstances change. For example:

  • A child support or spousal support / alimony award may be reduced if the person who has been ordered to pay support has an involuntary job loss or loss of income and is honestly unable to pay.
  • A judge may agree to terminate spousal support earlier than intended if it can be shown that the person receiving support is now capable of being self-supporting or the person paying support can demonstrate a significant loss of income or change of circumstance (such as a disability or retirement).

Some court orders made at the time of a divorce cannot be enforced until a certain set of circumstances has occurred. At the appropriate time, a client may need legal help to force the other party to act on the agreement. Examples include:

  • Forcing the sale of a home if the parties agreed to the sale and division of income from that asset once children had graduated from high school.
  • Enforcing the division of a retirement asset when the employee reaches retirement age and can access a qualified pension plan.

If you received an order from a California family court, but you no longer live in California, we can still handle your legal matter. We work with many out-of-state clients seeking modification of existing orders.
