Which bankruptcy option is best for me?
Chapter 13 bankruptcy is ideal for people with a steady income who have assets they want to keep. Chapter 13 stops foreclosure and can allow you to keep your house, sometimes eliminating second mortgages. Your debts are reduced or eliminated, and you develop an affordable payment plan for your remaining debts.
Chapter 7 bankruptcy can almost completely eliminate unsecured debts such as credit card debts, medical bills and personal loans.
As soon as we file either type of bankruptcy, you will enjoy an automatic stay to foreclosure actions, repossession and wage garnishment.
We will review your financial situation and recommend an appropriate course of action for you. These include Chapter 7 bankruptcy and Chapter 13 bankruptcy. If bankruptcy is not the right solution for you, we will tell you so.

By filing bankruptcy, can I keep my property?
As soon as we file either type of bankruptcy, you will enjoy an automatic stay to foreclosure actions, repossession and wage garnishment. Our firm will work to maximize your debt relief, while allowing you to keep as much of your property as possible. This includes your vehicles, bank accounts, retirement accounts and personal property.
In addition by filing a Chapter 7 or Chapter 13 bankruptcy you may be able to eliminate or reduce your non-secured debts such as credit card debt and medical bills. This can provide additional cash flow which can make it easier to manage your non-dischargeable debts.

By filing bankruptcy, can I stop creditor harassment?
Your lawyer can stop creditor harassment. According the Fair Debt Collection Practices Act (FDCPA), debt collection harassment is a serious offense. The minute Ms. Lee files a Chapter 7 or Chapter 13 bankruptcy on your behalf, creditors are not supposed to call you. They cannot contact you or file a lawsuit against you to collect on your debt. You are protected under U.S. bankruptcy law. If a creditor violates the injunction by harassing you or attempting to collect on a debt, they can be found in contempt and punished with a fine. If they contact you, all you have to do is refer them to your lawyer.
Ms. Lee and her office will handle all dealings with your creditors, so you can focus on getting your life organized again.
